Texas Constitution and Statutes – Penal Code – In Texas, DWI offenses and penalties are outlined in Chapter 49 of the Texas Penal Code, titled “Intoxication and Alcoholic Beverage Offenses.” This chapter defines various DWI-related offenses, including driving while intoxicated (DWI), driving under the influence (DUI) of alcohol by a minor, and boating while intoxicated (BWI).
