Texas Constitution and Statutes – Penal Code – In Texas, DWI offenses and penalties are outlined in Chapter 49 of the Texas Penal Code, titled “Intoxication and Alcoholic Beverage Offenses.” This chapter defines various DWI-related offenses, including driving while intoxicated (DWI), driving under the influence (DUI) of alcohol by a minor, and boating while intoxicated (BWI). Under Texas law, a person is considered legally intoxicated if they have a blood alcohol concentration (BAC) of 0.08 percent or higher while operating a motor vehicle. However, even if a person’s BAC is below 0.08 percent, they can still be charged with DWI if they are impaired by alcohol or drugs to the point where they cannot safely operate a vehicle.
